This fine is nearly 3 times the previous record, the $1.2 million fine I pointed to earlier. In the United States, the radio spectrum is "owned" by the federal government, so constitutional protections of freedom of speech do not apply. There are no objective standards for what might be construed as "indecent" speech - any frank or vigorous utterance might qualify - so broadcast expression has been reduced to only what cannot possibly offend anyone. Only a quarter century ago, Americans enjoyed greater freedom of expression that the people of any other country on Earth... | ||
